Company has researched and gathered publicly available information and provided this information to various clients for their use in making informed decision about their medical treatment options outside India.
 
NOW IT IS AGREED AS FOLLOWS:
 
1.      Company is by no means medical professionals and do not provide any advice on issues relating to medical treatment.
 
2.      The responsibilities of Company is limited to facilitating contact with, and providing information about doctors in United Kingdom, including their qualifications and credentials, the disclosed information is provided in order to aid the clients’ in making well informed decisions.
 
3.      Company will recommend preferred, qualified and specific doctors based on clients’ desired medical treatment options. This is in order to assure proper treatment and care while using Company as a medical outsourcing consultant specialist.
 
4.      Company advices clients using our services to thoroughly discuss all relevant medical issues with client’s medical doctor in India before making decisions on medical treatment in U.K. Company through their affiliates provides available medical treatment and recuperation options, as well as, packages inorder for client to make wise decisions about appropriate measures to take for client’s health needs and concerns.
 
 
5.      By signing this Medical Tourism Agreement , Client is agreeing to assume all associated responsibilities for his/her choice of doctors, medical personnel, health care providers, or medical procedures undertaken when choosing to use company as a consulting service.
 
6.      Company assumes no responsibility or liability for any treatment or other services rendered by any doctor, or for any malpractice claims and other claims that may arise directly or indirectly from any such advice, treatment or other services.
 
7.      To the fullest extent permissible pursuant to the applicable Laws, Company assumes no responsibility nor grants any warranties, express or implied relating to the operation safety condition or service of any physician, health care provider, hospital, aircraft, motor vehicle, boat or other conveyance, Inn, Lodge, or hotel and/or products associated with such entities or services that are used wholly or in part by, for or on behalf of Client.
 
8.      Company is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence or any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting there from.
 
9.      Client agrees that under no circumstances will Company or its affiliates, or any of c Company s or its respective Director’s, Officers, members, proprietors, partners, employees, agents, representatives, servants, attorneys, predecessors, successors or assigns, be liable for any indirect, incidental, special, punitive, exemplary or consequential damages including, but not limited to, lost profits, or loss of use, arising out o f the services provided by the Company , including but not limited to, Company s website, materials, arrangements made based on information obtained or through Company’s website or products or services obtained on or through Company’s  website.
 
10. The parties agree that any legal action proceeding under or with respect to this Agreement may be brought in the courts at Ernakulam. Client hereby agrees not to raise and does not waive any objection to, or any defense based upon the jurisdiction. Client also agrees not to bring any legal action or proceeding under or with respect to this Agreement outside Ernakulam or area where the legal issue occurred unless, for some reason, the Courts at Ernakulam or State of Kerala refuse or do not have jurisdiction in the matter.
 
CONFIDENTIALITY CLAUSE: Medicorp apply a strict confidentiality policy regarding information we collect from our clients. We will use any information collected, only to serve the best interests of our clients. We expect our clients to be responsible for the accuracy of the information provided. We are registered with the UK data protection act, and abide by its guidelines.

DISCLAIMER : Medcorp is a third party facilitator between patients and hospitals and tour operators in India. Medicorp does not offer or imply any medical or legal advice, or any kind of insurances. Clients are expected to take out their own adequate medical and travel insurance before they travel, to cover costs that may be incurred in any unforeseen circumstances. Medical disputes arising regarding the nature of the medical procedure, the quality of the care provided, or any part of their holiday, shall be dealt with in accordance with the local law prevailing in India.

FORCE MAJEURE : If, and to the extent, that Medicorp is hindered, or prevented, by circumstances beyond its reasonable control from performing any of its obligations under this Agreement then it shall be relieved of its liability to the Client for failure to perform such obligations.
